Many of our customers ask whether it is legal to record conversations and whether this can be used in any legal proceedings. To answer this question, it must first be stated that many people confuse the eavesdropping and recording of conversations, creating confusion.
Eavesdropping conversations
Eavesdropping means that a room or conversation is being monitored without your presence. This may be because you have placed a memo recorder in a room and listen to it later or that you have placed a channel in the room and immediately hear what is being said from a distance. Eavesdropping is not legal with a few exceptions.
Recording conversations
Recording conversations of which you yourself are a participant is legal and can therefore also be used in any legal proceedings. You also do not have to inform your conversation partner in advance of the fact that you are recording the conversation, even though this is often stated. The way in which you can determine whether you can legally record a conversation is fairly simple. This is because it depends on whether you are a participant in the conversation. So even when you have a telephone conversation with someone you can record this.
How to record conversations ?
