THERE IS NO REAL LAWS AND REGULATIONS FOR GPS TRACKERS
When you look at the code, it is striking that there is no real legislation and regulation. As an employer, it is therefore all the more important that good agreements are made. This way you can prevent discussions. Make the following things central when creating a Track & Trace policy:
- To use a GPS tracker must be a legitimate goal
The Dutch Data Protection Authority has drawn up rules. The Dutch DPA states that following employees must have a legitimate purpose and you must meet a number of requirements. The protection of your vehicles and your employees, the monitoring of employee performance and the optimization of movements are legitimate goals.
- Checking your employees must be in proportion to the goal
The goal you are aiming for must be important enough to use a GPS tracker for it. Can you pursue the same goal with lighter resources or can you guarantee your reliability without a GPS tracker? Then a GPS tracker is not necessary.
- You must inform your employees in advance
You must indicate in advance that a GPS tracker will be installed. You must indicate for what purpose you do this and what data is collected with your equipment. By registering the use of a GPS tracker with the Works Council, it is possible to collect evidence in a lawful manner. This way you can use the data of a Track & Trace system when firing an employee. If you do not report the use, the evidence may be assessed as unlawfully obtained.
