Is a camera allowed in the window?

  • 22 Mar 2021

Is it allowed to place a camera in front of the window? Yes, installing a security camera is allowed. But secret filming is not allowed. Most people don't think about this and place a camera in front of the window even though this is not allowed. The solution: place a sticker on the window or door or place a warning sign.

Hang up the camera without mentioning it

Municipalities install surveillance cameras to monitor. You see this a lot in the city center. These cameras are visible: everyone knows that he or she is being filmed. In addition, there is always a warning sign saying 'camera surveillance'. The municipality complies with the legal requirements regarding camera surveillance and privacy. Hanging a camera without a mention is only allowed if the camera films on your own property. This means they are not allowed to film public roads. However, you can view live images here. It does not matter whether you look outside the window or do this through a monitor. However, the images may not be saved.

A sign or sticker

You place a camera in front of the window to keep an eye on your own property and the public road. You must make this known by means of a sign or sticker. This says that you have a camera. If you do not post this warning, you are in violation. You may keep recorded images for a maximum of 28 days. In addition, you may not simply share these images with others. You may only show the images to the police in the event of crime. It is therefore not permitted to post these types of images on social media.

Complaint about security camera

Private individuals are not likely to complain about security cameras. However, it can be annoying when the neighbor films your property. Or you notice that someone is filming public roads without prior warning. In this case it is better to address the resident directly. If necessary, neighborhood mediation or a local police officer can help. If the neighbor or resident continues to film, you can contact the Dutch Data Protection Authority. These will determine what the best solution is. If necessary, you can go to court.

Broadcast images live (streaming)

It often happens that people broadcast images live, this is also called live streaming. Others enjoy looking at a particular street scene. Once again the following applies: broadcasting live images is not simply permitted. Just to be clear: with a notification that you are filming, you can place a camera in front of the window. By broadcasting afterwards you can remove portraits or copyrighted work. But when you stream live this is not possible and you are doing something that is unlawful. This can cause major problems.

Use of the spy camera

Secretly making recordings, for example because you do not trust something or someone? There is the spy camera for this. This comes in many different shapes and sizes, for example the alarm clock spy cam or the wall clock hidden camera. These types of cameras are ideal for monitoring employees, partners or roommates. This is only allowed when
