Legislation and regulations concerning camera security around the home
If you use camera security around your home it is good to know that this is not prohibited in principle. In principle, this is not covered by the Personal Data Protection Act and, for example, the Personal Data Authority does not supervise this. In this case, however, people expect that a camera is not aimed at the public road or property of someone else. If surveillance cameras are aimed at the public highway or if someone else's terrain and property is filmed, this is the case. The Dutch Data Protection Authority supervises in this case.
Recommendations Authority Personal Data
Are you aiming your surveillance cameras at someone else's property or site? Then the Dutch Data Protection Authority may interfere. It is therefore good to keep the recommended responsibilities. Think of:
- - Consider what you use your surveillance cameras for and write this down if necessary. This must be a legitimate interest: think of guarding your property. You may even determine who is responsible for this.
- - You must determine why the use of cameras is necessary.
- - Think about how long you keep surveillance images and what will be done with the images. Ensure that your surveillance images do not end up in someone else's hands.
- - Inform those involved if they will be filmed.
- - When you place images online, there must be permission from the people who can be seen on the camera images.

this document you can find the policy rules for the application of provisions from the Personal Data Protection Act and the Police Data Act. Did you record images illegally? That does not necessarily mean that this cannot serve as evidence. Keep in mind, however, that acquiring surveillance images in an illegal manner can also result in a fine or imprisonment for yourself.
